THIS NOTICE DESCRIBES HOW INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Introduction
At Welnia, we are committed to treating and using protected health information about you responsibly. This Notice of Privacy Practices describes the personal information we collect, and how and when we use or disclose that information. It also describes your rights as they relate to your protected health information. This Notice applies to all protected health information as defined by federal regulations.

Understanding Your Health Record/Information
Each time you visit Welnia, a record of your visit is made. Typically, this record contains your assessment and test results, and a plan for future health improvement. This information, often referred to as your health record, serves as a:
  • Basis for planning your care and treatment,
  • Means of communication among the many health professionals who contribute to your care,
  • A tool in educating health professionals,
  • A source of data for medical research,
  • A source of information for public health officials charged with improving the health of this state and the nation,
  • A source of data for our planning and marketing,
  • A tool with which we can assess and continually work to improve the care we render and the outcomes we achieve.

As noted, we gather information for purposes of providing and improving Welnia for you. For example, we use the information to allocate system resources and communicate with you about updates and new features, among other things. We also aggregate information supplied by users to maintain our services and describe user base to potential partners, investors and advertisers. In providing this aggregated data about our community of users, however, we do not reveal any user’s personally identifiable information.

There are some services provided in our organization through contacts with business associates. Examples include data management, laboratory services, etc. When these services are contracted, we may disclose your health information to our business associate so that they can perform the job we’ve asked them to do. To protect your health information, however, we require the business associate to properly safeguard your information.

To enhance our services, we may offer users the opportunity to participate in partnerships we may have with other businesses. If you choose to participate in one of these partnerships (for example, during the registration process), we may share with our partner the personally identifiable information it needs to identify its services to you. In such cases, we will clearly post notices to identify the partner.

We may reveal your personally identifiable information as necessary, if we reasonable believe that you are harming or interfering with other Welnia users, anyone else, or violating (intentionally or unintentionally) our User Agreement or infringing on any of Welnia’s rights. Welnia will reveal information, including personally identifiable information, to the extent it believes it is required to do so by law. If we are asked by subpoena or other legal means to disclose your information, we will, if permitted by law, attempt to notify you via any e-mail address we have on file for you at least ten days before we respond to the request. Although we currently do not make use of “cookies”, at some point in the future we may begin to do so. We will not begin such use without first posting the fact that we will do so, as appropriate. “Cookies” are stored on your computer and contain small bits of information sent by Welnia to your computer and read by Welnia when you visit different pages on the website. For example, cookies could allow us to remember your user name and password as you navigate around our site.

We do not rent sell, transfer or otherwise disclose your personally identifiable information to any third party, except in limited circumstances as set forth herein.

Your Health Information Rights
Understanding what is in your record and how your health information is used helps you to: ensure its accuracy, better understand who, what, when, where, and why others may access your health information, and make more informed decisions when authorizing disclosures to others. Although your health record is the physical property of Welnia, the information belongs to you. You have the right to:
  • Obtain a paper copy of this Notice of Privacy Practices upon request,
  • Inspect and copy your health record as provided for in 45 CFR 164.524,
  • Amend your health record as provided in 45 CFR 164.528,
  • Obtain an accounting of disclosures of your health information as provided in 45 CFR 164.528,
  • Request communications of your health information by alternative means or at alternative locations,
  • Request a restriction on certain uses and disclosures of your information as provided by 45 CFR 164.522, and
  • Revoke your authorization to use or disclose health information except to the extent that action has already been taken.

Our Responsibilities

WELNIA is required to:
  • Maintain the privacy of your health information,
  • Provide you with this notice as to our legal duties and privacy practices with respect to information we collect and maintain about you,
  • Abide by the terms of this notice,
  • Notify you if we are unable to agree to a requested restriction, and
  • Accommodate reasonable requests you may have to communicate health information by alternative means or at alternative locations.

Changes to this Notice: We reserve the right to change our practices and to make the new provisions effective for all protected health information we maintain. Should our information practices change, we will post a copy of current notice at our offices. The Notice will contain the effective data on the first page, in the top right-hand corner.

We will not use or disclose your health information without your authorization, except as described in this notice. We will also discontinue use or disclose of your health information in accordance with your authorization, after we have received a written revocation of the authorization, according to the procedures included in the authorization.

If you believe your privacy rights have been violated, you can file a complaint with the Welnia or with the Office for Civil Rights, U.S. Department of Health and Human Services. There will be no retaliation for filing a complaint with either the Operations Manager or the Office for Civil Rights.
